Under What Conditions Can a Non-VAT Taxpayer Paying Profit Tax or Income Tax Become a Simplified Taxpayer? According to the State Tax Service, Article 218.1 of the Tax Code defines the categories of persons eligible to become simplified taxpayers. Article 218.2 of the Tax Code states that a taxpayer who is eligible to apply the simplified tax regime (except for taxpayers specified in Article 218.4 of the Tax Code) must submit the relevant declaration or a written notification stating that they will not exercise the rights provided under Article 218.1 no later than April 20 of each year to the tax authority where they are registered. Unless otherwise provided by the Tax Code, a taxpayer does not have the right to change the selected taxation method until the end of the calendar year. If the taxpayer fails to submit the declaration or written notification within the specified period, the tax authority will apply the taxation method selected by the taxpayer in the previous tax year. A taxpayer who commences a new business activity during the year applies the taxation method indicated in the registration application submitted for tax registration.
